Terms of Use

These terms are an agreement between you and Memomoon LLC (“Memomoon,” “we”) about your use of the Memphys app and memphys.app (together, the “Service”). By using the Service, you agree to these terms. If you do not agree, please do not use it.

Who can use Memphys

Memphys is made for teens and adults. You must be at least 13 years old to use it. If you are under 18, or under the age of majority where you live, please review these terms with a parent or guardian, who agrees to them on your behalf.

Your license

We give you a personal, non-exclusive, non-transferable, revocable license to use Memphys on devices you own or control, for your own learning and not for commercial purposes. If you downloaded Memphys from the App Store or Google Play, that store’s terms also apply, and Apple or Google is not responsible for Memphys or its support.

Your content

Photos you take or choose, your handwriting and your voice recordings belong to you. They stay on your device, except as described in our Privacy Policyfor optional pronunciation scoring. Please only photograph things you have the right to photograph, and be considerate of other people’s privacy.

Points, levels and items

Points, levels, food, gifts, Memphyses and other items in Memphys are part of the game. They are earned by learning, have no cash value, cannot be bought, sold or exchanged for money, and are not your property. Because progress is stored only on your device, it can be lost if you delete the app or clear its storage, and we cannot restore it.

Learning content

Memphys is a learning aid. We work hard to make its words, characters, audio and explanations accurate, but they may contain mistakes. Speaking, handwriting and object recognition checks are automated and can be wrong. Memphys is not a substitute for professional instruction, translation or certification, and you should not rely on it where accuracy is critical.

Acceptable use

Please do not:

• copy, modify, distribute, sell or rent Memphys or its content;
• reverse engineer or try to extract the app’s source code or models, except where the law allows it;
• interfere with the Service, or use it to break the law or harm others.

Our content

Memphys, its characters (including Yalmi, Peppo and the other Memphyses), artwork, audio, lessons and software are owned by Memomoon LLC or its licensors and are protected by law. Some parts of the app are provided under open-source licenses, which are listed in the app and govern those parts.

Changes and availability

We may update, change or stop parts of the Service at any time. We may update these terms; when we do, we will post the new terms here and update the date at the top. If you keep using the Service after a change, the new terms apply.

Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement, to the fullest extent the law allows.

Limitation of liability

To the fullest extent the law allows, Memomoon LLC will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data or progress, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us for Memphys in the twelve months before the claim, or US$50. Some places do not allow these limits, so they may not apply to you.

Ending these terms

You can stop using Memphys at any time by deleting it. We may suspend or end your access if you break these terms. The sections on points, our content, disclaimers, limitation of liability and governing law continue to apply after these terms end.

Governing law

These terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in San Francisco County, California, unless the law where you live requires otherwise.
